It’s a guy playing the beginning of the game, it’s filmed in vertical with the phone :) Will most likely be taken down very soon.
I didn’t watch the intro, just skimmed through the gameplay parts, looks really good.

Also they are going to get their ass sued off by Bethesda/Microsoft.
Has that ever happened? Feels extremely unlikely.
Worst case (if you leak this close to launch, otherwise good luck) is you getting fired if you work at the game company.
